Ordering

Any order shall be in writing, letter, fax or e-mail and written confirmation by ArtisWebDesign Katrina Francke for its effectiveness. The same applies to any special agreements, additions and changes.

Quotation

After a preliminary meeting between the client and ArtisWebDesign Katrina Francke a detailed cost estimate will be sent to the client. In case the client places the order, this estimate will serve as specifications description for his project. The quotation is valid for 2 months.

For more complex projects the client will receive a supplementary document describing specifications and functionality of his website.

Additional services required which are not included in the cost estimate must be ordered in written form and will be charged separately.

Creation and Production

All services are provided directly by ArtisWebDesign Katrina Francke herself or through qualified third parties.

Design suggestions

After signing the contract ArtisWebDesign Katrina Francke produces and delivers the agreed number of design suggestions for the website.

If the client has to deliver text, pictures or other elements for his website that has to be done at the latest at this time.

Programming a standard page of the website

After the client has communicated the approval of the design, ArtisWebDesign Katrina Francke will progamme a default page of the website. This is then uploaded to the Internet where the client checks it and gives his agreement within 5 working days. (For urgent orders, this period is reduced to one working day.)

If within this period are no written claims have been received by the client, the standard page will be deemed accepted.

Structural changes to the design, layout or navigation, which are required after that date will be billed separately and will be delaying delivery to an appropriate date.

Completion of the website

After the client has agreed to the default page of his website, ArtisWebDesign Katrina Francke will finish off the site.

During the process of creating the website ArtisWebDesign Katrina Francke uploads the respective states of the work to the internet and thus gives the client the opportunity to track progress and to eventually ask for corrections or modifications.

Reception

Giving his consent to the completed website the client confirms the correct functionality of all included programming operations. The acceptance must be made within 14 calendar days.

If within this period are no written claims have been received by the client, the website will be deemed accepted.

If within this period the customer has not expressed any claims in a written form, then the standard page is considered as accepted by him.

The client is obliged to accept and acquire the site as long as it corresponds to the requirements described in the contract.

Hosting

The website is hosted with a provider of the client's choice which must meet the necessary requirements of the site (databases, PHP, script processing, etc.). The cost of the domain name and hosting is to be paid by the client.

Deadlines

Any agreement on terms and deadlines has to be made in writing. ArtisWebDesign Katrina Francke undertakes everything possible to respect the agreed dates.

Unforeseen or unavoidable delays exempt ArtisWebDesign Katrina Francke from compliance with the expected delivery date and allows her to postpone delivery to an appropriate date.

If the client during the implementation of the project wishes to incorporate changes that are not listed in the estimate or are made after partial acceptance of the affected part of the website, the agreed delivery deadline for the website will be postponed to an appropriate date corresponding to the additional workload.

The client is responsible for providing all data and information necessary for the implementation of his website. Any delay resulting from the denial of that responsibility is borne by the customer.

Rights and responsibilities

For the contents of the website the customer alone is responsible. He makes sure that his website does not infringe legal regulations or common decency by its form, content, or for the purpose.

ArtisWebDesign Katrina Francke also explicitly dissociates from all contents of all linked pages.

Liability

All orders are carried out with utmost care.

In case of damage ArtisWebDesign Katrina Francke is liable only for intent and gross negligence provided it does not involve the violation of a contractual obligation. Compensation claims are limited to the maximum value of the order.

Websites are optimized for and tested on different current computers and browsers (Microsoft Internet Explorer, Firefox, Opera in their respective current versions). There is no guarantee for the correct display of the programmed web pages on all systems and browsers.

ArtisWebDesign Katrina Francke is not responsible for damages resulting from changes in the web page files made by the client. Nor is ArtisWebDesign Katrina Francke responsible for damage caused by non-availability of the website due to server failure or similar circumstances.

The client assumes responsibility for the accuracy of texts and images as well as their competitive trademark rights and legal admissibility.

The recognition of defects must be reported to ArtisWebDesign Katrina Francke within 14 calendar days after delivery of the work. After that time the website is considered as received without errors. If the complaint is justified, ArtisWebDesign Katrina Francke will realize the corrections at her own discretion and free of charge.

The personal data entrusted by the client to ArtisWebDesign Katrina Francke serve only to execute customer orders. These data are stored and can be removed anytime upon request. ArtisWebDesign Katrina Francke agrees to maintain full discretion as not to transmit such data to third parties.

Copyright and usage rights

Upon full payment, the customer acquires all rights of exploitation and use of his website as well as its individual components.

ArtisWebDesign Katrina Francke owns all copyrights of the web pages and the programs, files and graphics. Any resale by the client, even in modified form, requires the express consent of ArtisWebDesign Katrina Francke.

Terms of payment

For orders of less than 1000€ a deposit must be paid of 50% of the budgeted amount.

In orders above 1000€ an advance of 33% of the quotation is to be paid. The second payment of another 33% will be made when receiving the uploaded default page of the website.

The remainder is payable after completion and publishing of the website.

Minor defects do not absolve the client of his obligation to pay. Until the full payment of all required work has been received, the work submitted will remain property of ArtisWebDesign Katrina Francke.

Contract Cancellation

The cancellation of the contract does not relieve the client of his binding order issued.

If the client cancels the contract before ArtisWebDesign Katrina Francke has started with the work on the website or if he prevents such work (conduct contrary to the contract), he will be obliged to make a payment of a 50% of the total order.

If the client cancels the contract or prevents the work after the start of the work on his website, he will be liable to pay the entire amount agreed.

Final provisions

One or more provisions should be or become invalid, the other provisions shall remain unaffected. The ineffective provision shall then be replaced by such legally effective regulations that achieve the intended purpose. The same applies to omissions.
